AV Silver and Gold Awards Program

OFFICIAL RULES

No purchase or contribution required to enter and/or  win with the "AV-Today.com Silver or Gold Rewards Program.".

Eligibility: This Silver and Gold Rewards program is open only to persons who are, as of January 1, 2006, age 18 or older, legal residents of the United States (excluding its territories, military installations and commonwealths) and the District of Columbia. This Silver and Gold Rewards Program is void in states where prohibited by law. Employees of AV-Today.com ("Sponsor")  are not eligible to participate, win or use the prize.

Entry: The Silver and Gold Rewards program begins at 12:01 a.m. Pacific Daylight Time ("PDT") on January 1, 2006, and ends at 11:59 p.m. PDT on December 31, 2006 (the "Silver and Gold Rewards Period"). During the Silver and Gold Rewards Period, become a registered user of AV-Today.com Silver and Gold Rewards program and you will be automatically entered into the rewards program.  You may also enter without becoming a registered user by hand writing on a plain 3”x5” card in plain block letters  "Silver and Gold Rewards Program” and mailing the card with First Class postage attached to: AV-Today.com, 37765 53^rd Street East, Palmdale, CA 93552. Entries submitted without becoming a registered user with AV-Today.com must be received by December 31, 2006 at 11:59 p.m. PDT. Entries generated by script, macro or other automated means are void. By entering and participating, you fully and unconditionally accept and agree to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all matters. By entering, you also agree to waive any right to claim ambiguity or error in these Official Rules or in the Sweepstakes itself. Any attempted form of entry other than as described herein is void. Entries made by becoming a registered user will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right to request proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry. In the event of a dispute as to who submitted an online registered user, the prize will be awarded to the name on the authorized account holder. Released Parties (as defined below) are not responsible for incorrect or inaccurate transcription of entry information, for problems related to any of the equipment or programming associated with or utilized in the Silver and Gold Rewards program, for any technical or human error which may occur in the processing of the entries in this Silver and Gold Rewards program, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access any Web site or online service, for any other technical or non-technical error or malfunction, for lost, late, stolen, incomplete, garbled, misdirected or entries not received by deadline for whatever reason. Incomplete entries will be disqualified. Entries become the property of Sponsor and will not be returned.

Conduct: If for any reason the Silver and Gold Rewards program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical corruptions or failures, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Silver and Gold Rewards program, Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her Sweepstakes entries) who tampers with the entry process, and to cancel, terminate, modify or suspend the Silver and Gold Rewards program and void such entries. Should the Silver and Gold Rewards program be suspended or terminated prior to the stated termination date, notice will be posted on the applicable websites. In the event this Silver and Gold Rewards program is terminated, the prizes will be awarded in a random drawing, in the case of Silver and Gold Rewards program termination, from among all eligible, non-suspect entries received by the termination date.

Drawing: Potential winners will be selected by random drawing weekly from among all eligible entries received by the Silver and Gold Awards program Administrator., whose decisions are final and binding in all respects relative to this Silver and Gold Rewards program. Eligible entries made between 12:00am PDT and 11:59 pm PDT on each applicable day of the Sweepstakes will be included in the drawing. The winner will be notified by e-mail within approximately two (2) weeks of the drawing date. If any potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible, or if he/she cannot or does not comply with these Official Rules, he/she will be disqualified. Odds of winning depend on number of eligible entries received.

Prizes: $25, $50, $100 Prizes are non-transferable. No substitution, transfer or cash redemption or substitution of prize is permitted. Number of prizes awarded depend on number of prizes claimed after winners are notified by e-mail or USP mail if entry is by same. If any potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible, or if he/she cannot or does not comply with these Official Rules, he/she will be disqualified. If a winner has not responed by e-mail within 30 of notification to accept his/her prize, this will be deemed a resonable effort and that prize will be disqualified from the prize pool. Prizes will be paid by checks and/or gift certificates/cards made payable to the advertiser in which the winning entry has indicated or elected to spend the awards. 

Conditions: Each potential winner may be required to sign an affidavit of eligibility or a liability release and, where lawful, a publicity release (collectively "Affidavit/Release"), all of which must be signed, notarized and returned within fourteen (14) days of date of issuance if reqested by the sponsor or prize  will be forfeited. Prizes or prize notifications which are undeliverable or unclaimed will be forfeited. By returning the completed Affidavit/Release, winner attests the authenticity of his/her winning entry.  All applicable federal, state, local or other political division or subdivision laws and regulations apply.

Release: By participating in this Silver and Gold Rewards program, all participants acknowledge and agree that AV-Today.com and their respective parents, subsidiaries and affiliates, advertising and promotion agencies, licensees, those involved in the development, production, implementation, and distribution of this Silver and Gold Rewards program, and/or any other persons or entities associated with this Siler and Gold Rewards program, including, but not limited to persons affiliated with Siler and Gold Rewards program Sponsor, and the respective officers, directors, shareholders, employees and agents of the forgoing entities (collectively, the "Released Parties") are released, discharged and held harmless from and are not responsible or liable for any liability with respect to all aspects of this Silver and Gold Rewards prograom (including without limitation, any illness, losses, litigation, personal injury, death, property damage, and claims based on publicity rights, defamation, or invasion of privacy, reasonable attorney's fees and court costs) that may occur from participation in this Silver and Gold Rewards program and the acceptance, possession, use or misuse of any prize (including any travel related thereto). In the event that any dispute arises regarding the meaning or interpretation of these Official Rules, participants agree that the dispute shall be resolved by applying the laws of the State of California, and that it shall be resolved within and by the courts of that state. Winners' names available after December 31, 2006, until May 31, 2007, by accessing the Internet and typing AV-Today.com/pages/silverandgoldrewards. These Official Rules will be posted at AV-Today.com.
